Article 1 (Definitions)
In these Terms, the terms set forth in the following items shall have the meanings respectively assigned to them below.
- "the Service" means, collectively, the browser game "VagrantCrown" provided by us and its related websites and features.
- "we" means Nexlim Inc., the operator of the Service.
- "User" means any person who uses the Service, regardless of whether that person has registered an account.
- "Guest Play" means using the Service without registering an account, in a state where the User is identified by a browser cookie.
- "Account" means a state in which a User's Game Data can be continuously identified by means of an email address and password, or by linkage with an external service (Discord or Google).
- "Game Data" means progress, inventory, characters, records, and any and all other data recorded on the Service as a result of a User's operations.
- "Paid Items" means items, in-game currency, and other electronic data usable only within the Service that a User purchases for consideration.
- "Free Items" means items, in-game currency, and other electronic data usable only within the Service that are granted to a User through game progress, rewards, or otherwise without payment of consideration.
Article 2 (Agreement to These Terms)
- A User shall be deemed to have agreed to all provisions of these Terms at the time the User begins using the Service.
- The Service may be used without registering an account; in that case as well, these Terms apply in the same manner.
- If you do not agree to these Terms, please refrain from using the Service.
- When using paid services, in addition to these Terms, the content displayed on the purchase screen and the content of the "Notation based on the Act on Specified Commercial Transactions (特定商取引法に基づく表記)" shall apply.
Article 3 (Eligibility)
- In principle, the Service is available to anyone.
- We have no means of verifying the age of Users. Matters relating to age shall be determined at the responsibility of the User and the User's legal representative (parent or guardian).
Article 4 (Use and Purchases by Minors)
- If a minor uses the Service, the minor must obtain the consent of a legal representative (parent or guardian) in advance. In particular, persons under 13 years of age must use the Service only with the consent and under the supervision of a legal representative.
- If a minor uses paid services (makes purchases), the minor must obtain the consent of a legal representative on each occasion. If a minor User completes a purchase procedure, we shall deem that the purchase was made with the consent of a legal representative.
- If a legal representative requests rescission of a purchase made by a minor User without the consent of the legal representative, we will confirm the circumstances through the contact point set forth in Article 23 and respond in accordance with applicable laws and regulations. In this case, we may ask for the submission of necessary documents to verify identity and to confirm that the requester is the legal representative.
- If we accept a rescission under the preceding paragraph, the Paid Items granted through the relevant purchase shall be forfeited, and we may, at our discretion, also revoke any in-game benefits obtained by using those Paid Items.
Article 5 (Guest Play and Data Retention)
- The Service may be started as a guest without registering an account.
- Game Data from Guest Play is identified by a session cookie stored in the browser. This cookie is valid for 180 days from issuance and is automatically extended for as long as the Service continues to be used.
- In any of the following cases, access to Game Data from Guest Play will be lost and cannot be restored:
- If the browser's cookies are deleted
- If the Service is accessed from a different browser, a different device, private browsing, or the like
- If the validity period has elapsed since the last use
- To retain Game Data continuously and use it from multiple devices, please link an Account as set forth in Article 6. We bear no responsibility whatsoever for the loss of data of Users who have not linked an Account.
- Paid services are available only to Users who have created an Account. This is because, under Guest Play, purchased Paid Items cannot be restored if lost.
Article 6 (Account Registration and Management)
- A User may create an Account for the Service by registering with an email address and password, or by linking a Discord or Google account.
- Users shall keep their registration information accurate and up to date.
- Users shall manage their passwords and linked accounts at their own responsibility and shall not lend, transfer, or share them with any third party.
- Any and all acts performed using an Account shall be deemed acts of the User who holds that Account. We bear no responsibility for damage arising from inadequate password management, use by a third party, or the like.
- If you suspect unauthorized use of your Account, please change your password promptly and contact us.
Article 7 (Prohibition of Multiple Accounts and Declaration of Use on the Same Connection)
- Each User may hold only one Account. The creation, holding, or use of multiple Accounts by the same User (so-called sub-accounts) is prohibited.
- Guest Play data may be carried over to only one Account.
- If multiple persons use the Service from the same connection (the same IP address) (family members, siblings, persons living together, etc.), please submit a self-declaration through the contact point set forth in Article 23 after each Account has been created. If such a declaration is submitted, we will treat the relevant multiple Accounts as not falling under the prohibition in the preceding paragraph.
- If multiple Accounts are used from the same connection without the declaration set forth in the preceding paragraph, we will presume this to be a violation of paragraph 1 and may take the measures set forth in Article 17. Please submit the declaration before we detect any violation.
- We may contact you to confirm the content of a declaration. If a declaration is found to be false, the declaration shall be invalid and shall be subject to the measures set forth in Article 17.
- The creation or use of multiple Accounts for the purpose of gaining an advantage in rankings, rewards, or other in-game systems is prohibited regardless of whether a declaration has been submitted.
Article 8 (Prohibition of RMT (Real-Money Trading))
- Users shall not engage in any of the following acts (hereinafter referred to as "RMT"):
- Exchanging, or attempting to exchange, an Account, Game Data, in-game currency, Paid Items, or Free Items for real money or any other thing of property value (including electronic money, crypto assets, points, and items of other services)
- Conducting the transactions described in the preceding item, regardless of whether under the name of sale, transfer, lending, provision as collateral, or any other designation
- Soliciting, intermediating, or brokering, or advertising, the transactions described in the preceding items (whether within or outside the Service)
- Creating Accounts, progressing in the game, acquiring items, or the like for the purpose of RMT
- If we reasonably determine that RMT has taken place, we will, without prior notice, suspend (BAN) and delete all Accounts involved in the transaction (whether on the selling, buying, or intermediary side). In this case, the Paid Items held by the relevant Accounts shall be forfeited, and no refund of the consideration therefor will be made.
- Even if a User suffers damage as a result of RMT, we bear no responsibility whatsoever and will not intervene in any dispute between the parties to the transaction.
- In-game currency and items are functional values usable only within the Service, and we do not guarantee to Users any property value outside the Service.
Article 9 (Prohibited Acts)
In using the Service, Users shall not engage in any of the following acts.
Acts that impair the fairness of the game
- Improperly altering the operation of the game by modifying the game client, altering memory, tampering with communications, or by any other means (cheating)
- Automatically progressing in the game by using automated operation tools, macros, BOTs, scripts, or the like
- Using the API of the Service by any means other than the official game client
- Intentionally exploiting bugs or defects in specifications to obtain benefits that cannot be obtained by ordinary means
- Excessive access to the Service, load testing, or any other act that places a significant load on the servers
- Any act that violates the prohibition of multiple Accounts set forth in Article 7
- Any act that constitutes RMT as set forth in Article 8
- Fraudulent use of payment methods, making purchases without the intention to pay, or improperly filing a chargeback (cancellation of payment) after payment
Acts relating to systems and rights
- Unauthorized access to the Service, circumvention of authentication, searching for or exploiting vulnerabilities, or intrusion into another person's account
- Analysis, reverse engineering, unauthorized reproduction, unauthorized reposting, or redistribution of the source code, assets, or data of the Service
- Any act that infringes copyrights, trademark rights, or other rights of us or any third party
- Sending or providing computer viruses or other harmful programs
Acts relating to others and public order and morals
- Entering, in the display name, self-introduction, or any other input field, content that defames or slanders others, discriminatory expressions, obscene expressions, political or religious propaganda, advertising or solicitation, personal information of others, or any other inappropriate content
- Harassment, impersonation, or nuisance directed at other Users, third parties, or us
- Any act that violates laws and regulations or public order and morals, or any act related to criminal activity
- Providing benefits to, or otherwise cooperating with, anti-social forces
- Any other act that we reasonably determine to be inappropriate
Article 10 (Withdrawal and Account Deletion)
- Users may withdraw from the Service at any time and request the deletion of their Account and Game Data.
- Withdrawal may be carried out from the withdrawal procedure screen within the Service. If you are unable to use that screen, please contact the contact point set forth in Article 23. In this case, we will verify your identity and respond within a reasonable period.
- Upon withdrawal, Game Data, held items (including Paid Items), and unused in-game currency shall all be forfeited. These cannot be restored after withdrawal.
- Upon withdrawal, no refund or other reimbursement whatsoever will be made for purchased Paid Items or unused in-game currency. Withdrawal is carried out at the User's own discretion; please complete the procedure with this understanding.
- Even after withdrawal, we may retain certain records (purchase history, audit logs, etc.) to the extent necessary for legitimate purposes such as preventing fraudulent acts, complying with laws and regulations, and keeping accounting and tax records. For details, please refer to the Privacy Policy.
- Paragraphs 3 and 4 of this Article shall apply mutatis mutandis where an Account is subjected to suspension or deletion under Article 17.
Article 11 (Paid Services)
- The Service includes paid services through which Paid Items may be purchased for consideration.
- Sales prices (including the amount equivalent to consumption tax) are displayed on each purchase screen within the Service. Communication charges and other costs necessary for payment shall be borne by the User.
- A purchase is concluded when the User, on the purchase screen within the Service, confirms the purchase details and price and performs the confirmation operation.
- Payment methods shall be those displayed on the purchase screen within the Service. Payments are processed through the payment service provider engaged by us (Stripe, Inc.). We do not retain Users' credit card numbers or other payment information.
- Paid Items are granted to the User's Account immediately upon completion of the purchase procedure.
- Paid Items and Free Items may be used only within the Service. They cannot be exchanged for other services, other Users' Accounts, real money, or any other thing of property value (Article 8).
- The validity period of Paid Items shall be the period during which the Service is provided; provided, however, that for Paid Items sold with an individually specified validity period, the validity period shall be the period displayed on the purchase screen.
- In-game currency issued for consideration (hereinafter referred to as "Paid Crown Gems") may be used only for 180 days from the date of grant, and shall be forfeited upon the expiration of that period. No reimbursement, extension of the validity period, re-grant, or any other compensation whatsoever will be provided for forfeited Paid Crown Gems. The validity period is calculated from the date of grant and shall not be extended by reason of the date of last use or any other circumstance.
- In-game currency granted free of charge (hereinafter referred to as "Free Crown Gems") has no validity period. If a User holds both Paid Crown Gems and Free Crown Gems, Paid Crown Gems with the nearest expiration date are consumed first. This treatment is intended to avoid forfeiture due to expiration of the validity period to the extent possible.
Article 12 (Refunds and Cancellations)
- Because Paid Items are digital content provided immediately upon completion of the purchase procedure, in principle we cannot accept cancellations, returns, or refunds after purchase.
- Notwithstanding the preceding paragraph, in the following cases we may, at our discretion, provide a refund or re-grant Paid Items of an equivalent amount:
- If purchased Paid Items were not granted due to reasons attributable to us
- If Paid Items did not have their intended effect due to a defect on our part
- If a refund is required by laws and regulations (including rescission by a minor under Article 4, paragraph 3)
- Because the Service constitutes mail-order sales, the cooling-off provisions under the Act on Specified Commercial Transactions do not apply.
- We cannot accept refunds for reasons of the User's own convenience (including refunds on the grounds of an error in the purchase details or dissatisfaction with the game's specifications or difficulty).
- If an Account is subjected to suspension or deletion under Article 17, no refund will be made for Paid Items held.
Article 13 (Treatment under the Payment Services Act)
- In-game currency and Paid Items issued in the Service may be used only within the Service and are not subject to reimbursement.
- If we fall under the category of an issuer of prepaid payment instruments as defined in the Payment Services Act (資金決済に関する法律 / 資金決済法), we will make the necessary indications, notifications, and the like under that Act. If the unused balance exceeds the threshold amount specified in that Act, we will take measures such as depositing issuance security under that Act.
- If reimbursement is made under that Act (in cases falling under grounds specified by laws and regulations, such as the termination of the Service), we will announce the method on the Service.
Article 14 (Game Data and Intellectual Property Rights)
- Copyrights and other intellectual property rights in the Service and in any and all content included in the Service, including programs, images, text, audio, and game balance, belong to us or the legitimate rights holders.
- Ownership of and any and all rights in Game Data and items (including Paid Items) belong to us, and Users have only the right to use them within the Service in accordance with these Terms.
- With respect to information entered by Users on the Service, such as display names and self-introductions, we may use such information free of charge to the extent necessary for the provision and operation of the Service, ranking displays, handling of defects, and introduction and promotion.
Article 15 (Changes to Game Content and Data Adjustments)
- We may change, add, or remove game balance, features, specifications, item performance, and the like without prior notice to Users. The performance of Paid Items may also be changed for the purpose of adjusting game balance.
- In cases such as fixing defects, responding to fraudulent acts, or where there is another legitimate reason, we may modify, roll back, or delete a User's Game Data.
- We bear no responsibility for any disadvantage incurred by Users as a result of measures taken under this Article; provided, however, that if Paid Items become unusable due to reasons attributable to us, we will respond in accordance with Article 12, paragraph 2.
Article 16 (Campaigns and Granting of Bonuses)
- For purposes such as promoting use of the Service or making announcements, we may conduct campaigns for a specified period and grant Free Items or other bonuses to Users.
- The content of campaigns, conditions for participation, types and quantities of bonuses to be granted, timing of grants, and upper limits shall be determined by us and announced on the Service or on our official accounts.
- Bonuses shall be granted to Accounts that are using the Service at the time of grant determined by us. Accounts created after the time of grant, and Accounts subject to measures under Article 17 (Restriction of Use and Account Suspension), are excluded from grants.
- Bonuses are granted through in-Service mail or any other method determined by us. If the claim deadline determined by us has passed, the relevant bonus shall be forfeited. Forfeited bonuses will not be re-granted.
- If we reasonably determine that any of the following applies, we may change or cancel the content of a campaign, cease granting bonuses, or revoke bonuses already granted:
- If figures relating to the achievement conditions of a campaign have been manipulated by automated means or any other fraudulent method
- If there has been an act in violation of Article 7 (Prohibition of Multiple Accounts) or Article 9 (Prohibited Acts)
- If conducting the campaign or confirming the achievement conditions becomes difficult due to changes in the specifications of external services, failures, or any other reasons not attributable to us
- Bonuses granted through campaigns are Free Items and are granted without payment of consideration. We bear no responsibility for any disadvantage incurred by Users as a result of measures taken under this Article.
- Even if we conduct a campaign using an external service (such as X (formerly Twitter)), the operator of that external service is not involved in the campaign.
Article 17 (Restriction of Use and Account Suspension)
- If a User violates these Terms, or if we reasonably determine that there is a risk of such violation, we may take the following measures without prior notice:
- Suspension of use of all or part of the Service
- Modification or deletion of Game Data and items
- Suspension (BAN) and deletion of the Account
- Forced invalidation of login sessions
- Suspension of use of paid services thereafter
- We are not obligated to explain the reasons for the measures set forth in the preceding paragraph; provided, however, that if a User so requests, we may conduct a re-review at our discretion.
- As a result of measures under this Article, held Paid Items and unused in-game currency shall be forfeited, and no refund of the consideration therefor will be made.
- We bear no responsibility for any damage incurred by Users as a result of measures under this Article.
Article 18 (Interruption and Termination of the Service)
- We may interrupt the provision of all or part of the Service without prior notice in the following cases:
- When performing maintenance, inspection, or updates of the system
- When provision becomes difficult due to natural disasters, accidents, failures of communication lines, failures of cloud services we use, or the like
- In any other case where we determine that an interruption is necessary for operational or technical reasons
- We may terminate the provision of the Service at our convenience. In this case, we will announce the termination on the Service, to the extent possible, at least 30 days before the termination date; provided, however, that this shall not apply where there are unavoidable circumstances such as natural disasters, changes in laws and regulations, or business or technical reasons.
- After the announcement of termination of the Service, new sales of Paid Items will cease.
- Upon termination of the Service, all Game Data and items (including Paid Items) will be lost. We bear no liability whatsoever, including for compensation, for any damage incurred by Users as a result, except where reimbursement is required by laws and regulations.
Article 19 (Public Information such as Rankings)
- The Service includes a ranking feature that discloses Users' display names and records to other Users.
- Display names are viewable by other Users. Do not set your real name or any other personally identifiable information as your display name.
- We may change or delete, without prior notice, any display name or self-introduction that we determine to be inappropriate.
Article 20 (Disclaimer)
- We make no warranty whatsoever, whether express or implied, that the Service is fit for any particular purpose of a User, that it has expected functionality, accuracy, or usefulness, that it will be continuously available, or that no defects will occur.
- We bear no responsibility for any damage incurred by Users as a result of the use of or inability to use the Service (including the loss of Game Data and items), except in cases of willful misconduct or gross negligence on our part.
- Any dispute arising between a User and another User, or between a User and a third party, shall be resolved at the User's own responsibility and expense, and we will not be involved.
- We bear no responsibility for events occurring on external websites linked from the Service or on external services used by the Service (Discord, Google, payment service providers, etc.).
- If a full exemption of our liability is not permitted under the Consumer Contract Act (消費者契約法) or other mandatory laws, we shall be liable only for direct and actual damage that would ordinarily arise, and the amount of compensation shall be capped at the total amount of consideration paid by the relevant User to the Service during the 12 months preceding the time at which the damage occurred.
Article 21 (Amendments to These Terms)
- If we deem it necessary, we may amend these Terms without individual notice to Users.
- The amended Terms shall take effect at the time they are posted on the Service; provided, however, that if we make a material amendment that substantially restricts the rights of Users, we will announce it on the Service with a reasonable period of advance notice.
- If a User uses the Service after an amendment, the User shall be deemed to have agreed to the amended Terms.
Article 22 (Severability)
Even if any provision of these Terms or any part thereof is held to be invalid or unenforceable, the remaining provisions and the remaining part of such provision shall continue in full force and effect.
